Terms and Conditions for Cargo Delivery
General
Before proceeding you will be required to show that you have read and understood the following terms and conditions. We recommend that you print a copy of these Terms and Conditions for your future reference. Below you can find our Terms Of Use. The Terms are a legally binding contract between you and Pazar3. This contract sets out your rights and responsibilities when you use MerrJep, our mobile apps, and the other services provided by Pazar3, so please read them carefully. By using any of our Services (even just browsing our websites), you’re agreeing to the Terms. If you don’t agree with the Terms, you may not use our Services.

Pazar3 is a digital platform for advertising and has the role of an intermediary between The Seller and The Buyer. It is not a typical e-commerce website and does not offer direct selling from the website. For the process of selling and buying the product, The Seller and The Buyer agree by themselves. Pazar3 offers an online web platform where The Seller may advertise their products.

The Buyer is every private person/business entity that buys/purchases something via Pazar3 from The Seller.

The Advertiser/seller is every private person/business entity that sells something via Pazar3. On the platform, The Advertiser may be a business entity or a private person with or without a registered account at Pazar3.

The Cargo Company is the company that delivers the products to The Buyer (from The Seller).
Pazar3 is NOT responsible for the quality of the products from The Sellers (The Seller is responsible for the products he/she is selling/offering). Pazar3 is NOT responsible for the quality of the delivery of the Cargo Company (the Cargo Company is responsible for the services that are offered by them).

This site is owned and operated by Pazar3.al. Our registered office is in Resen, Tashe Miloshevski 6, 7310 Resen, Republic of North Macedonia. All rights on this website are owned by us. Any unauthorized use, copying, or modification is prohibited.

Both Pazar3 and The Seller’s personal information (for example, buyer name, email address, and shipping address) and are therefore considered separate and independent data controllers of buyers’ personal information under Macedonian Law. That means that each party is responsible for the personal information it processes in providing the Services. For example, if a seller accidentally discloses a buyer’s name and email address when fulfilling another buyer’s order, The Seller, NOT Pazar3, will be responsible for that unauthorized disclosure.
All the included parties (Pazar3, The Seller, The Buyer and the Cargo Company) in the delivery process agree and confirm that the information and data exchanged, will be kept confidential and will not be shared with third parties in writing, verbal, electronic, or any other way.
The security of your personal information is important to us. We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and after it is received. Unfortunately, no method of transmission over the Internet or method of electronic storage is 100% secure. Therefore, while we strive to protect your personal information, we cannot guarantee its absolute security. Your account information is protected by a password. It is important that you protect against unauthorized access to your account and information by choosing your password carefully and by keeping your password and computer secure, such as by signing out after using the Services.
Payment Terms
General Overview
The prices shown on Pazar3.al do not include the price for shipping the product. Prices of the Goods to be sold are always set by The Seller/ The Advertiser. It is The Advertiser, the person who determines the value of his product totally based on his judgment. Pazar3 has no responsibility or influence in determining the prices or costs of the product.
Shipping costs are clearly indicated and billed at the end of the order, in addition to the price of the products. The price that will appear on the website after you have completed and confirmed the order, will be the final price and the only amount that you will be obliged to pay at the time of receipt of the product.
The price of the delivery service will be calculated regarding the criterias by the Cargo Company (for example the weight) and will be shown on the ad details section. So the user will be able to see the amount of the cargo delivery service before the confirmation of the delivery. Delivery service is not available for all categories (for example Cars, Services etc.). For the additional special packaging, bigger products etc, the price and the terms of delivery may vary and The Seller/buyer and the Cargo Company will take care of that.
Payment Method
Payments for the Goods are made with the cash on delivery method. The Buyer receives the package, has time to inspect it a maximum of 10-15 minutes, and commits the payment of the Item Value and the Delivery Cost.

Delivery is paid by The Buyer (Delivery Cost + Item Value).

The Cargo Company, after receiving the money for the Goods Delivered, notifies The Seller that the order has been delivered. After the successful delivery, the Cargo Company should deliver the money to The Seller on time.

If The Buyer refuses to receive the order, the shipping costs may need to be paid by The Buyer. The cost of delivery to The Buyer in such cases is not refundable, because the delivery service has already been provided.

If The Seller recalls the product before it arrives at The Buyer’s location, The Buyer will not have to pay for the delivery. From the moment it comes to the Cargo Company branch, The Seller can recall the parcel. If The Seller has withdrawn the shipment, the delivery cost will be covered by The Seller.

If The Buyer is not contactable and has shown to have an invalid address or phone number, the shipping costs may need to be paid by The Seller upon receipt of the item's return because The Seller counts as responsible for the deal with whom he or she has made.

If The Seller wrongly selects a weight that is higher than what the product weighs, then The Seller has to pay the difference, or if The Seller refuses, then The Buyer has to contact and be informed about the new delivery service price. If both seller and buyer refuse to pay the difference, the postman can cancel the order.

If The Seller selects a weight that is less than the original weight of the item. The Cargo Company should not charge the agreed amount (higher in this case) but has to charge only what the product weighs.
Terms of Service
Pazar3 Delivery service is an opportunity to purchase without prepayment and with sending to the Cargo Company.

Only a registered user who has been verified in his Pazar3 profile can use the delivery service.

The service was created to make the buying and selling process on Pazar3 safe. Money for the goods from The Buyer to The Seller goes without disclosing any data and only if the goods are received by The Buyer after inspection.

The Cargo Company has three days to arrange a pickup from The Seller. After the time runs the order will be canceled.

Delivery is paid by The Buyer (Delivery Cost + Item Value).

If The Buyer is not contactable and has shown to have an invalid address or phone number, the shipping costs may need to be paid by The Seller upon receipt of the item's return because The Seller counts as responsible for the deal with whom he or she has made.

The product waits for The Buyer for 5 days, after which a return is issued to The Seller.

When the parcel has been delivered, The Buyer will have 10-15 minutes to inspect and confirm the item's condition.

For delivery questions, the customers should contact the Cargo Company by phone or Email.

Users can track the statuses of orders issued with the Pazar3 Delivery service themself: in the Pazar3 profile, in the Cargo Company Personal Account, using the mobile application and tracking on the Cargo Company website.

Support notifications - The customer will be notified during status and event changes. The customer may be notified by SMS, email, or through a Telephone call.
Public Agreement
The Cargo Company is obliged to perform the following services in an accurate, timely, with the maximum speed, quality, and professional way:

Reception, transport, sorting, and distribution of postal – courier parcels including services for regular letters, registered services, express services, courier services, transportation of the bigger products, and all other acceptable products under the conditions provided in the general authorization pertinent to the territory of the Republic of North Macedonia.

The prices for provided services will be defined in a price list which is implemented into the website for every category separately. Exceptions to the price list for a certain client may be done regarding the type of the product. For some kind of product, the price will be defined additionally in communication with the client.

To provide daily updates of provided services and the status of the parcels on time, real-time updates, or at least on a daily basis on their system.

To introduce a procedure for addressing and solving claims submitted by the users of the postal service.

After the successful delivery, the Cargo Company should deliver the money to The Seller on time.

In order to achieve maximum efficiency in the delivery of documents or goods, the Cargo Company undertakes to review the delivery of the shipment, in cases where the recipient is not at the address at the time of delivery. This in case the address is correct. In cases where the address is incorrect and requires completion, the sender will request its re-verification and The Seller will continue with the delivery process without requiring additional obligations.

The Cargo Company is obliged to maintain the secrecy of the correspondence, as well as to take care of the confidential treatment of any information he receives regarding the activity of the customer.

The Cargo Company is obliged to respect the obligation for the protection of the client's data, in accordance with the requirements of the law "On Postal services & Transport in the Republic of North Macedonia."

The Cargo Company strictly prohibits the trafficking of all elements prohibited by law such as narcotics, weapons, etc. of this type, unless the law expressly allows such a thing.

The Cargo Company should enable The Buyer at the moment of delivery to check and inspect the goods for around 10-15 minutes before the delivery.

Pazar3 is obliged to provide the service provider with all the required information regarding the elements necessary for the performance of the service such as addresses or other elements that help to perform the delivery service professionally.

Pazar3 will provide an online pop-up to the customer to fill the data for the delivery service.

If the product is a sensitive product that may be broken easly, the seller should specify with a special label or sticker that the transportation needs more attention because the product is fragile.

If the roads of the final destination of the buyer is not passable or there are some barriers, work activities, obstacles, etc. the product will be shipped at the first nearest place that there is a possibility to be delivered. The buyer and the cargo company will talk about that additionaly if there is a need for a change on the price or something else.

If the product is very big and is not possible to be delivered by one person and on hand, the buyer and the cargo company will agree about the delivery conditions (price, delivery time, etc.). The prices will be defined by agreement for this kind of product delivery activities.

If the buyer is not on the provided adress and ask for sending the package on another adress, the Cargo company may define different price and delivery time for this delivery.

Pazar3 is not responsible If the customer has any remarks or complaints regarding the work of the cargo company, the delivery man, the cargo service etc. All the remarks and complaints regarding the cargo service should be resolved directly with the cargo company.
Term of Service of Cargo Company
With these rules of the agreement for the users of the postal service agreement of ELS Logistic, are defined the rights, responsibilities and obligations of the parties involved for executing the postal services. The postal services of ELS Logistic may be used by all physical people and businesses who want a secure and effective delivery. Parties may agree on other rules for postal services, for which they create individual agreements that are a part of the current general rules.
Courier services provided by ELS Logistic:

Taking shipments from the client’s address (Sender/Buyer) with the address form;

Taking letters from the address of the Client (Sender/Buyer) with the filled form for sending more letters from the same sender (Receipt Book);

Transportation of shipments with the receiving archive address form;

Delivery of the shipments with the final address form to the recipient's address;

Delivery of the normal/important letters with/without final address form to the address of the recipients;

Taking letters from the post and delivering to the post.

Shipment announcement: Every working day from 08:00 to 16:00. The announcement is made by phone or e-mail or in an application that can be accessed via the web.
